ebotCPA PLLC ("ebotCPA," "we," "us") is a licensed Texas CPA firm. This policy explains what we collect through ebotcpa.com, how we use it, and the rules that govern our handling of your information.

What this policy covers. This policy covers this website. It does not replace the privacy notice we provide to clients under the Gramm-Leach-Bliley Act, the confidentiality terms in your engagement letter, or any consent you sign under Internal Revenue Code §7216. Where those documents apply, they control. ebotCPA Academy operates under a separate policy at ebotcpaacademy.com.

1. What we collect

Information you give us. When you submit a form on this site, we collect your name, email address, phone number, state, the type of IRS notice you received, an approximate balance range, the number of unfiled years, and anything you write in the message field.

Information collected automatically. IP address, browser and device type, pages viewed, time on page, and the site that referred you, through standard web analytics.

What we do not collect on this website. No public form on this site asks for a Social Security number, ITIN, EIN, date of birth, bank or card number, or document upload. Those are collected only after engagement, through a secure client portal.

2. How we use it

To respond to your inquiry, prepare a Case Analysis if you engage us, schedule and conduct consultations, send you communications you have asked for, operate and secure the site, and meet our legal and professional obligations.

We do not sell your information. We do not share it with advertisers or data brokers.

3. Tax return information and IRC §7216

If you become a client, information you give us in connection with preparing your return is tax return information, protected by Internal Revenue Code §7216 and Treasury Regulation §301.7216. Under those rules we may not disclose or use that information for any purpose other than preparing your return without your prior written consent, given knowingly and voluntarily. Unlawful disclosure carries criminal penalties under §7216 and civil penalties under §6713.

When we ask for that consent, it is a separate, specific document — not a checkbox buried in a form. Every consent we collect on this site is stored with the exact text you agreed to, the version of that text, and a server-generated timestamp.

4. Safeguards

Tax preparers are treated as financial institutions under Title V of the Gramm-Leach-Bliley Act. We maintain a Written Information Security Plan under the FTC Safeguards Rule, 16 CFR Part 314, consistent with IRS Publication 5708. It covers access controls, encryption, vendor oversight, staff training, and incident response, and it is reviewed at least annually.

As a Texas CPA firm we are also bound by 22 TAC §501.75 (confidential client communications) and the AICPA Confidential Client Information Rule.

5. Who we share information with

We share information only with service providers who need it to operate the practice — website hosting, analytics, scheduling and CRM, email delivery, document exchange, and payment processing — each bound to confidentiality and permitted to use it only for the services they provide to us. We also disclose information where required by law, subpoena, court order, or a lawful request from a regulator, and where you have directed us to, for example by asking us to file Form 8821 or Form 2848 with the IRS on your behalf.

6. Cookies and analytics

We use cookies and similar technologies to operate the site and understand how it is used. You can block or delete cookies in your browser; parts of the site may not work correctly if you do. We do not use cookies to build advertising profiles.

7. Email and text messages

Email. You can unsubscribe from any marketing email using the link in the message. We will still send you messages about an active engagement.

Text messages. We send text messages only to people who have given us a mobile number and agreed to receive them. Agreeing to receive texts is not a condition of becoming a client or of purchasing any service. Message and data rates may apply and frequency varies. Reply STOP to cancel or HELP for help. We do not share mobile numbers with third parties for their own marketing.

8. How long we keep it

Inquiries that do not become engagements are retained for 24 months and then deleted. Client records are retained for the period required by our records-retention policy and applicable professional and tax record-keeping standards. Consent records are retained for as long as the underlying record, plus the applicable limitations period.

9. Security incidents

If a security incident affects your sensitive personal information, we will notify you without unreasonable delay and no later than the 60th day after we determine a breach occurred, as required by Texas Business & Commerce Code §521.053. Where an incident affects at least 250 Texas residents, we will also notify the Texas Attorney General as soon as practicable and no later than the 30th day after that determination, using the electronic form on the Attorney General's website.

10. Your choices

You may ask us to confirm what information we hold about you, correct it, delete it, or stop sending you marketing. Write to admin@ebotcpa.com or call (817) 214-4014.

A note on Texas law. The Texas Data Privacy and Security Act, Tex. Bus. & Com. Code Ch. 541, does not apply to financial institutions or to data subject to Title V of the Gramm-Leach-Bliley Act. Because our handling of client financial information falls under GLBA, the Act's consumer-rights provisions largely do not reach us. We honor access, correction, and deletion requests anyway, except where retaining a record is required by law, by tax or professional record-keeping obligations, or to establish or defend a legal claim.

11. Visitors outside the United States

This site is directed to people in the United States and our services are provided under United States law. If you contact us from outside the United States, your information will be processed in the United States, where privacy protections differ from those in your country. ebotCPA Academy, which enrolls students internationally, is governed by its own policy and its own data map.

12. Children

This site is not directed to children and we do not knowingly collect information from anyone under 13.

13. Changes

We will post any change here and update the effective date. Material changes will be noted at the top of this page for 30 days.
